The following terms and conditions ('Terms of Use') govern your access to and use of the Portal, whether as a guest or a registered user.

By using the Portal, or by clicking to accept or agree to the Terms of Use when this option is made available to you, you accept and agree to be bound and abide by these Terms of Use. If you do not want to agree to these Terms of Use, you must not access or use the Portal.
This Portal is offered and available to users who are aged eighteen (18) and older and who are residents of the United States. By using the Portal, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Portal.
1. Changes to the Terms of Use.We may revise and update these Terms of Use from time to time in our sole discretion. Changes are effective immediately when we post them, but are not retroactive. All other names, logos, product and service names, designs and slogans on this Portal are the trademarks of their respective owners.

1.Facilitation Tool Only; Disclaimer of Related Warranties and Liability.The Portal is solely a communications and networking tool that enables connections between residents and their community and between residents and other residents. Except for facilitating such connections through the Portal, we do not take part in the interactions between residents and their communities, or between residents and other residents, and we are not responsible for such interactions. You are solely responsible for such interactions. We are not a party to any relationship or contract between residents and their communities or other reisdents. All dealings are solely between the respective parties.
The Company cannot and does not assure or make any guarantees or warranties as to whether or not it is safe for you to have direct contact with other users of the Portal. You agree that you are solely responsible for and that you assume all risk in your interactions with other residents with which you have connected via the Portal, including, but not limited to, in any off-line interactions. You agree to take all necessary precautions when meeting in person any residents or participating in any events with which you have been connected via the Portal.
The Portal is designed to facilitate the sharing of information by users with other users. The Company strongly advises you to use extreme caution before sharing any personally-identifiable information with other users of the Portal. If you believe that any user of the Portal is harassing you or is otherwise using personal information about you for unlawful purposes, we encourage you first to inform local law enforcement authorities and then to contact us at hello@viibrant.comso that we may take appropriate action to block further use of the Portal by any such user.

The availability of any products or services (e.g., food or dining services) offered by your community via the Portal does not imply our endorsement of such products or services. Your community is not affiliated with the Company in any way. As noted in and without limiting Section 17 of these Terms of Use, we cannot and do not control, are not responsible for, and make no representations regarding (i) the existence, quality, timing, suitability, reliability, safety or legality of any goods, services or events advertised or promoted by your community through the Portal, (ii) the truth or accuracy of any advertisements, promotional materials or other information supplied by your community or other residents through the Portal, or (iii) whether any good or service offered by your community through the Portal will meet your requirements.
As noted in and without limiting Section 18 of these Terms of Use, in the event that you have a dispute with your community or with one or more residents, you hereby agree to release us (and all of our officers, directors, agents, investors, subsidiaries, and employees) from any and all claims, demands, damages (actual or consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
1.Changes to the Portal.We may update the content on the Portal from time to time, but its content is not necessarily complete or up-to-date. Any of the material on the Portal may be out of date at any given time, and we are under no obligation to update such material.
2.Links to Other Sites.You may create a link from another site that you own to our homepage, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
